Is it possible to take the parents of a kid to court?

Ok, a few hours ago my son was in a fight, the other kid punch him first, and then he beat up my son pretty bad on the face, chipped a molar, well my son looks and feels bad. He went to the ER right now.
Is there any way I would win in a civil court, if I take this kid and his parents and sue them for the medical cost? I talked to the cops and they told me that if my son wants to have this kid arrested that they have the right to ask the kid if he wants my son arrested. (the kid is 17 and my son 16). My son didn't do any damages to the other kid, he didn't have a chance to defend himself.

So basically can I win in a civil court?
We have witnesses, and I took pics. He started to get a bad headache so my husband took him to get a MRI or CT Scan.
 
yes, because his punch was in self defense, so they have no chance of counter-suing. you can win in a courtroom if you have a good attorney, and all your proof and facts strait.
this other kid needs to be taught a lesson. if not prison, then his parents should have to pay for what he has done.

bring all the information on the attack you have, contact legal council, and ask about your options, how much you'll have to pay the attorney, and how much you can get. you can get a good win.
if the parents want to avoid a courtcase, you might even be able to negotiate a settlement where you receive enough money to pay for your son's bills, and have some left over.
i also think that a restraining order would be necessary between your kid and the brat. (ask your kids opinion first, he might not want to.)

make sure your kid doesn't keep getting bullied. that brat's behavior is completely unacceptable.

I would go ahead and file suit in small claims court for the cost of all your son's medical bills. You won't get pain and suffering, but you do have a good chance of winning. Bring witnesses, if any, who saw the other kid throw the first punch too. (Your chance of winning isn't very good if your kid threw the first punch.) Don't go the criminal route, your son absolutely can also face assault charges if the other parents decide they want to pursue that.
