Is it illegal to steal tips in the restaurant where you are employed?

My boyfriend is a server at a locally-owned restaurant. He and one of the owners are the only two servers on duty at night. My boyfriend makes a flat wage plus he gets part of the tips. Supposedly, the owner who works with him as a server gets to keep the remainder of the tips. She doesn't have any formula for calculating how much tip he gets and it seems like sometimes he only gets $5-10 tips for a whole night. He has counted the tips and seen that the owner keeps a lot of it for herself.

Recently, my boyfriend has started taking a few dollars here and there from some tables and keeping it in his apron instead of putting it where the tips are supposed to go. It usually amounts to about $20 a night which he thinks makes it more fair.

I am worried what he is doing is illegal but he thinks it is okay. Could he get in trouble with the law or is he only risking his job?
Just to clarify... he is not stealing tips from another server's tables. They are from his own tables. Personally, I think he should be able to split them half and half with the owner.
