It really doesn't matter — it is impossible to reliably detect if music is being illegally uploaded or downloaded. There would be false positives.

Even if it were possible — where? The law is different is different places.

If the music industry began to add a certain kind of software, like a virus, to physical music media and the files on that media, that would only attack a person who is illegally downloading or uploading the files, could they be sued or would it be considered illegal? KEEPING IN MIND, that for the software to be unleashed, you have to be either illegally uploading or downloading.

How would they know if it is being legally shared or illegally shared. It is legal to email yourself music files and transfer them from device to device as long as you paid for that file..That would cause you to infect your own system.

You couldnt do it.

Sony put malware on their CDs and got taken to court. It was on their legal Cds but if you downloaded it illegally you didnt get malware.

Also on torrents people write comments when they download the music. It would only take about 10 downloads before people commented and it was taken off.

If sony could write a pecice of malware which did that. People will have come up with a way of removing it within a week. Even microsoft cant make a product people on the internet cant hack.

Right... umm, yes, it'd be wrong to do so. Why? Because remember, people also copy the music for their own enjoyment onto their mp3 players. And if the virus/malware... unleases once copied, people won't buy music anymore...
