Is it illegal for lifeguards to have electronics on the job?

I've recently been to a pool that only has one lifeguard and he brings his phone, his laptop, his kindle, his DS and whatever else he can fit into his bag to work with him. He even does it when people are in the pool. Even when people aren't in the pool, he's still on duty, so why does he do this?
