Lately, I have noticed there has been a particular urgency to consider people of different ethnic backgrounds and sexual orientations for the supreme court, if simply to break the prevalence of white males on the court. Likewise, Elena Kagan does seem to give the outward appearance of a gay female (consider for instance Chastity Bono, who now looks remarkably similar to Kagan as a male). With that said, I would just like to know in all seriousness if anyone knows if Elena Kagan is gay, perhaps having knowngly been nominated by Obama for that reason in an attempt to diversify the court. Of course if this were the case it would probably be left unsaid for an indefinite period of time, but my concern is that I do not believe it should be seen as something to hide or be ashamed of, and I would certainly hate to think that this information would be withheld because it is believed it would affect her chances of being appointed to the court. Is it even something that can legally be withheld in lieu of a decision being made?
