Is a pocket bike motorcycle in the same class as a real motorcycle or

concidered a moped? im having an arguement with a friend i am saying that a pocket bike is a motocycle class because u dont pedal it to start it but he says it is a moped class can someone help me settle this please
i dont care if it is not street legal i know they r not but i just want to know by classification what is what
 
i win pocket bikes are not street legal they say right on them for off road use only!
 
It is not either one.
It is just a toy.
In most states, the definition of "moped" no longer includes pedals.
