is a law suit that is filed under civil rights act section 1983 a civil suit?

ok, let me clarify a bit...
if a prisoner is suing the prison under section 1983 for unconstitutional prison conditions, is that a civil suit or a criminal suit?
 
A lawsuit is always a civil suit, no matter which Act it is filed under. A lawsuit is where one party seeks a remedy for wrongs committed by another party. A lawsuit, a civil suit and a civil action are different names for the same thing. Basically, it means someone's getting sued. Not all court cases are lawsuits.

EDIT: If anyone is suing anyone, it's a civil suit.
