I was involved in a car accident a few months ago. We pulled over and exchanged info. I took photos as well. She had slight damage, the damage was more on my front bumper. Police came by but did not take statements or file a report. Insurance would prob view it as my fault but we decided to not go through insurance.
The other driver calls me a few days later telling me she will get an estimate from a body shop and let me know the cost. She said we don't have to go through insurance since it will probably be less than $500.
Well, after that conversation she never contacted me again until recently. She is now saying that I never called her back (I was waiting for her to call me with the quote) and said she will go to the DMV (California) if I do not return her calls and get this settled.
What is the proper way to go about this? Should I just let her go through insurance? I know the 10 day rule from DMV applies to damage about $750, so does that mean she cannot get more than that from me? Or that it cannot be filed at all?
If she lies and said the accident was recent, will the photos I take prove that the accident was not recent? Who knows what kind of condition the car may be in now and its weird that she calls me out of the blue about this. I figured she didn't care anymore since the damage was very minimal and its an older car.
