payer cannot afford to pay? UK - how will judge/court view this?
If the H's net income is £2600 pcm but he has to pay £750 mortgage, £300 for a loan for his wife's debt and £381 in child support (1 child aged 14) - he really only has a net income of £1169.
Will the court consider this? In this case the W lives in marital home and there is no mortgage to pay. Her net income (not working) is £1088 though she also sells some crafts.
She has applied for interim and spousal maintenance - I just wondered if judge just compares £2600 vs £1088 or if he takes into account H's additional outgoings?
