In virginia can an employer hold your last check under any circumstances other

than tax or garnishment? I'm a painter and was tape recorded at work because my boss said I would "go off" on her. I didn't quit and said we needed to talk about this, you cant just record a one sided dispute at work. Anyway they say they wont give my check until I return paint brushes and a few small items. Can they do this in Virginia and also can I pursue the tape recording? I have no real proof except my word, she pulled it out but I heard nothing. Thank you for any answers or help, don't know how to pursue this, also he doesn't pay overtime and I have stubs to prove he only pays straight wage
