In the state of California, can you go to jail for...?

Being caught with alcohol in your system during an accident that you caused & being under twenty one all at the same time?
My brother was recently in an accident with alcohol in his system & when the police came, they arrested him because he was under twenty-one & put him in jail. My parents had to bail him out in the dead of night. He has court soon, what consequences does he face & can he go to jail? If so, for how long?
Someone got a few stitches, but they're fine. He didn't crash into anyone else, just a dumpster.
Oh, & his license was taken away.
& he's twenty.
 
it all depends on if someone was hurt or killed. if someone was killed in the accident then jails very likely
 
Now a day's DUI is taken hard. If the accident did not hurt anyone i think he will be charged underage drinking and DUI most likely probation if this is his first offense.
 
Why don't you just state his age?

You stated, the police arrested him and took him to, "jail," so I'm assuming he is at least 18.

If that's the case, he is looking at the loss of his driver's license, a hefty fine, restitution, 48 hrs in jail, probation, drug/alcohol classes, (which includes other monetary fees,) and sky high insurance rates once he's again eligible to drive.

Even a first offense in the state of California is a very expensive experience, in more ways than one.
 
If you brother was giving any kind of test either breath or blood test and he fails it he can be charged with DWI. Yes, he can do jail time depending on the accident.
 
His car insurance will be higher than his car is worth, if he still has a drivers license.
