The nominates are duly audited by a reputed concern like KPMG who reveals just he 5 top contenders in each category. Technical categories are decided by the respective trade associations - like for cinematography, it is decided by the members of ASC (American Cinematographers Association). So, Martin not getting an Oscar so far goes to prove, he has some distance to go before he can achieve the milestone.However the irony of this system is, let us say a person has performed exceedingly well in 2008, and there is another person who has outperformed him and got the award.
