I am being chased for a debt which i thought i paid off 10 years ago, i have moved a few times and changed jobs so i forgot about a couple of debts i had, however, this company sent me a letter in january this year, i looked into it and discovered that i could claim the debt as statute barred and it would be illegal for them to chase me for it, they sent a letter saying it wasn't as i'd allegedly made a payment 4 years ago but they refused to send me proof, this went on for a couple of months so i sent everything to the ombudsman. The records that they sent the ombudsman show i made payments upto march 07, but when i got copies of the record 5 months after i asked for them i can say 100% that the documents have been falsified as the payments were recorded as cash or cheque payments and i have had the same bank account for 12 years and not written a cheque from it for over 8 years, i contacted the company and accused them of committing fraud and they replied they don't do that and will have to contact the company they bought the debt from, i gave them 28 days to supply account details from the cheques or receipts from the cash payment or i will pass the matter onto the police, this was 2 months ago and they will not reply to my letters or e-mails and i will not phone them. this is for about ?2.5k which could only be late payment and interest fees
My question is, is my complaint valid, which police department do i refer it to and how?
it's not a civil complaint....i am claiming that they have committed fraud in an illegal attempt to obtain money from me, that sounds like a crime, especially for the fraud squad don't you think?
i wrote to the FSA, who replied that because the account was in dispute they couldn't get involved.
The company chasing me has been on BBCs Watchdog twice and i have threatened to write to them also.
The limitations act states that continuing to pursue a statued barred debt is illegal and could be classed as harassment
