I recently lost an auction for a domain because I knew that in the event of a bidding tie, the domain would go to whoever placed the first bid. I naively thought I was the first bidder because the dictionary defines outbid as bidding more than someone else. I thought I was that someone else. So when we both bid the same price(the standard initial bid), I disregarded the outbid status as extraneous. Am I a complete idiot or can someone outbid AND be the first bidder? I guess my question is, does this constitute misleading conduct? They could just as easily use the mutually exclusive two term status "Winning Bid." Do I have any legal recourse or can someone call a shoe a hat?
