if passengers are drinking alcohol in a car, does driver get charged?

only the driver gets charged, nothing happens to the passenger. its similar to seat belt laws, the driver is responsible for ensuring that everyone in the car is wearing a seatbelt, he is also responsible for ensuring there is no open alcohol in the car.
 
if vehicle passengers are drinking alcohol in the back with out the drivers knowledge and the car gets pulled over. Does the driver get charged with open liquor or does everyone in the car get charged with it?
