If no court was involved in the custody of my child, can I get my child back?

I made the heartbreaking decision of letting my 3 year old little boy go and live with his dad. I still have regular access to him.
Reason being he didn't get on with my partner, whom I have a 1 yr old baby with.
He would get very upset and extremely jealous. He was a very unhappy little boy and it broke my heart seeing him like that. Me and my partner were arguing a lot. I had to face horrible decisions such as break up with my partner and leave my youngest without his dad around full time which was unfair on them both or my 3 yr old go and live with his dad and be happy and keep me, my partner and our baby together and be happy or do I keep things the way they are and keep everybody unhappy and sad.
We let the whole situation go on for about 18 months hoping he would grow out of it but he didn't. My little boy has now been living with his dad for about 2 months and he now gets on with my partner extremely well which Im really happy about but can't quite understand why he needed to go to his dad's for this to happen.
I would now like my little boy to return home to live with us. But need to no if this is possible as we didn't go to court to do it all legally and have me sign him over through the courts. We just have a written agreement between us that he in custody.
 
Just talk to your ex husband about getting him back. By sending him to his dad you made him feel like he does not matter that you care more for your partner and your other child. Also never fight in front of the children, and discussing problems is more mature than fighting about them.
