So my husband was involved with some horrible things, when CID came to our home to search (which I signed consent having no clue what was going on...was fine anyway, he wasn't doing his thing from our house off post, he had a barracks room I guess) On top of that his anger was getting out of control and he stopped going to anger management and therapy(I tried so hard to stick it out with him hoping things would get better... ugh) Well... I kicked him out for our animals and my safety from him and filed divorce back in July. I didn't ask for anything, and he took everything, but he refused to sign the papers because he allowed to live for free in the barracks & only had to give me half the BAH and he got the other half and BAS to waste away. I have a protection order against him so I do not/have not spoke with him since July. Only to his divorce lawyer. I DO speak (secretly) to a somebody in his COC who has kept me updated as much as he can. I know that he went to his UCMJ and plead guilty(or however it works in the army court thing) He was sentenced to 90 days in military prison, demoted to E1 rank during that 90 days. I know he's getting 1/4 of the E1 pay while he's in prison. So I expected I, still being his wife would have got my allotment for BAH...now I just lost my job because I am a private nanny and have the swine flu & pneumonia so I have been pretty sick & "infectious" for 3 weeks...doctor said today it'll probably be another few weeks as today's chest Xray showed the pneumonia has got worse. I was really counting on BAH because I can NOT pay rent and have nobody to turn to here. How is he getting 1/4 E1 rank pay but not still getting BAH? Why would the military just abandoned the family that way? I understand he's wasting the military's air sitting in prison for 3 months, but he's STILL in the military until the end of the 3 months. I don't know if he has just stopped the allotment thinking "I'm already going to prison what more is cutting her off going to do to me?" Or if he really DIDN'T get paid the BAH. It was ONLY for being married, it wasn't for his rank prior to being demoted. JAG won't talk to me whatsoever because he changed his power of attorney and is in prison. IG won't tell me anything. His chain of command has been nothing but trouble for me since I filed for divorce(There are about 45 people in his company(or brigade or however that goes) who got in trouble, went to prison, or have got a BCD regarding the same thing my husband is serving his time for right now....so the unit is pretty corrupt and hard to deal with. Sorry I seem pretty ignorant but we have only been married a little over a year & I haven't been around the military before him so I don't know a ton. But please let me know if I should be getting BAH or not.

Ok that's fine. I just didn't know if he had cut me off to be a jerk or if it was the military about the BAH. That's really awful though, I'm so thankful I'm divorcing him and we have no kids. Must be horrible for a wife/mother to lose everything because her husband does something bad. I imagine she would leave him, I couldn't stay married to somebody who could do something bad enough to deserve prison time!! But it still would be so hard with children involved. Sad stuff.
How is it he's getting part of his actual paycheck? He's only getting 1/4 E1 which I can imagine isn't much at all, but how would he being allowed that even? Is it because he's in a military prison that they must somehow keep him a member of the military through pay until he gets out of prison and his BCD? I just don't get it, or understand any of it!
