If an ins. comp. retroactively cancels an auto policy, do they have to pay out claims...

...to victims? I was recently involved in an accident, where a motorcyclist rear end my vehicle at a red light. While trying to get them to pay for a rental until my car is repaired, they started making noises about "retroactively cancelling" the policy on the motorcyclist. Can they do that? Or would they have to pay out the claim to me (the victim) and then sue the owner of the cycle for insurance fraud?
