I'm waiting for an unlawful detainer trial as a landlord and I made a foolish mistake.
I sued 3 defendants and when I submitted the default judgment request for 2 who didn't answer, I submitted an amended complaint with "John Does Tenants" fixed which it wasn't even mentioned on the answer. Very foolish and very long story - but I followed a court clerk's instruction and get into this situation.
I got rejection on the default judgment request on first two because the clerk is now saying that I have to re-submit the default judgment request with the new date from the amened complaint date and I have to serve this to all three defendants.
Trial date is 3 days away and there's no way that I can get this to them in person - they were very difficult with me on everything - rejecting letters, not answering the door.
So my question is, if I don't serve the amened complaint to the defendant on time, will judge dismiss it? Or should I ask the judge to dismiss it? Will he listen to me?
I can't really afford a lawyer because of the financial damage that these defendant caused me. I don't think I can delay anymore days. I need them to be out of the property ASAP. I'm a full time working mother of two children and this whole situation is really overwhelming.
Please help me.
