If a realtor covers up black mold with paint on a house you planned to buy?

If the seller and/or the Real Estate Agents involved attempt to conceal something like that you can certainly sue them.

What I recommend however, rather than sue them, get inspections by a licensed Mold Inspector, a licensed Contractor, a licensed Roof Inspector and a licensed Pest Control Inspector.

By the time that you are through with those inspections you will know more about the house than the seller and the Real Estate Agents.

Get estimates of the cost of repairs and deduct the estimated cost of repairs plus a margin of about 30% from the estimated fair market value of the house to arrive at the maximum amount of your offer.

You want a margin of at least 30% over the estimated cost of repairs to take care of unanticipated additional repairs when you open up the walls and you want to be compensated for your time and the inconvenience of having to make the repairs yourself after you buy the house.
 
and you have an inspector come and tells you there is black mold present, can i sue the realtor or home owner? I already KNOW there is mold in this house because my friend lived there and i want to buy it if they fix it but i WILL know if they just painted over it when i go to look at the house because it was growing down the wall from the ceiling. What are my options legally if theyre trying to cover up the mold? Also i want to save someone else from buying it if they dont fix the mold but how could i do that?
black mold is toxic and deadly i live in michigan so im pretty sure its illegal to hide or cover it up, they would have to disclose the information even if i was locked into an as is deal which i am not im simply interested. I just dont know what to do if i try to buy the house and they dont disclose the information to me, i know how sneaky realtors are and they can lose their license for fraud i think but im not sure
Ok so maybe not SUE but i would want to press charges or something, i have kids and its a WHOLE WALL of black mold toxic black mold or not, if they LIE and cover it up isnt that against the law? The reason im so sure theyre going to try to cover it up is because my friend who bought the place was told there were no leaks and the first rain living there they noticed the roof leak
I am NOT looking for a "quick buck" so go eff off. I simply do not want them to get away with this to me or someone else. The realtors advice was the best advice but if i go out and get 10 different inspectors im paying cash out my a.s.s. for a house i might not even buy? You get me?
Why i would want the house isnt really your concern, but since you asked its a beautiful house other than the mold and in the location i need to be. mold can be fixed and im willing to fix it i just dont want to be lied to or schemed on and want to know what to do with the "what ifs" when they arise
 
legally nothing you can do..that is the reason why you hire an inspector to check out the house..some times home owners will not fill in the realtor on anything in the home is bad that not visible to the eye..

so the answer to your question is no, you can't sue or anything in that sort.
 
no, you cannot sue them if you have not yet purchased the house and you are just in the deal phase unlessyou can prove they had intent to decieve you in the deal....

however, in most cases you can leave the deal without any strings if you signed the agreement on the condition of a home inspection. you also have the ability to re-submit your offer, for the current offer price, less the estimate for the mold removal

if you signed a locked-in deal prior to inspection or 'as is' deal, that wasn't wise and you may have no legal recourse
 
You don't need to sue, just tell the r/e guy you want the situation remedied as a condition of sale. Same with any other problems the inspector found.

You have no duty to subsequent buyers.
 
well, you simply would not buy the house....why would you sue anybody? not selling the house only hurts the actual homeowners. besides, the homeowner will correct the problem at their cost if you were still interested in buying. They will have to fix it anyways if they are attempting to sell.

You can hire another inspector (at your cost) so you can inform him of the former leak if you feel the original inspection did not discover the mold that you now exists. It is also a possibility that the mold has been taken care of since you/your friends lived there previously.

IF YOU KNOW THE HOUSE HAS TOXIC MOLD, THEN WHY ARE YOU ATTEMPTING TO BUY THE PROPERTY?
 
YOU would have no case. If you already KNOW a problem exists, you CAN'T rely on the misrepresentation that the problem does not exist. Also note, ANY problem found BEFORE you buy is grounds to either void the offer, or require repairs before the sale. In either case, you have no damages to sue for.

Also note: The REALTOR probably doesn't know what the current OWNER attempted to hide. You are going after the wrong party.
