...out of jail? Lets say someone sentenced to five years in jail for possessing a pound of marijuana. If marijuana becomes legalized two years from now, would that person have to finish his sentencing? Would he be able to appeal the ruling?
 
No, he would still have to finish his sentence. A crime was committed.

Turn it around, lets say (for purpose of example) you drink a bottle of whiskey. If whiskey is made illegal, should you have to be punished for drinking it when it was legal?
