Hello could do with so advice

If a court orders contact with the non-resident parent and the mother takes the child to the said place and time etc and the child refuses to go with the non-resident what will happen?

Social serves has said its not in the child’s best interest and so has a psychologist has said its not in the child’s best interest but I can’t afford to fight this anymore ive run out of money and I cant get legal aid .so the only thing left for me to do is say ok if that’s what he wants fine but it’s a different matter to what the child wants

What will happen to me if she refuses to go with him?

Get back in contact with both child services and the psychologist and ask them for statements to the effect that it is not in the childs best interest. These are professional and if they dont believe it is in the best interest of the child, then so be it. Get those statements and dont take the child if he doesnt want to go.

Then, if you are dragged back into court for disobying a court order, kindly hand the letters or statements to the judge and simply state, these experts on children say its not in my childs best interest and that is why I didnt take the child to see the father. I was willing, but the child didnt want to go.

As a mother it is your first obligation to take good care of your child, both physically and emotionally. Screw that court order. You have a bona fide reason why you disobeyed it. BUT make sure you have these statements for validation of your actions.

You really dont need an attorney for that, if you get a notice to appear in court because you didnt obey the court order, just show up and give these statements to the judge and tell him your childs best interest comes FIRST. You should be fine, you got expert testimony on your side!
