owner is the insurer liable to fix? there is sitll pmts owned on the car by the owner????? is the insurer liable for fixing the car???????????????????????
the person that was driving at the time of the accident is not named on the policy anywhere only the person whose name the insurance is in and they were not driving when it occurred, they was not even in the car when it happend.
 
The insurer is only liable for the limits of the policy coverage. The question may well be whether the driver was named as such on the policy. Did the insurer KNOW that the car is not owned by the policyholder or has someone lied here?

The fact that the car is financed has nothing to do with it.
 
Why was the insurance in the name of someone other than the owner of the automobile ? Generally speaking, you cannot insure the vehicle of another without an addendum to the policy indicating so. An example would be a leased vehicle, on which the person leasing the vehicle provides insurance, while the vehicle is owned by the lease company. If such information was not provided to the insurer, the coverage may well be invalid.
