I was at gym class, and the teacher insisted that i leave my ipod touch in the valuables safe box (a plastic box the teacher uses to store valuables during gym class) and i said it would be safe with me. Nevertheless, she made me put it in the box. At the end of class, me and my friend were the only ones left out of the students and the teacher was still there. We had to get to a maths test and so i completely forgot about my ipod and ran for maths. We left after the teacher.

The next gym class we had, i asked her where it was (normally, the teacher will hold on to the left over items and wait for someone to claim them) and she said she didn't know if there were anything left over after class. Normally, she spills all the valuables on the middle of the gym floor for people to get, so she can put away the box. I asked her if she had seen anything afterwards, and she hadn't.

At this point is asked my dad what I should do. He said I should write a note with his signature asking for a replacement, and that I should write what the teacher said down. i did so and i dated it and wrote down the time that I asked.

I am going to ask for the replacement tomorrow and I need people's opinions as to whether i have a legal advantage or not and am i likely to get my ipod replaced. I live in Sydney, Australia and am in year 9. plz help
