i only just bought it and the back is very scratched which is anoying me. Can i return it saying that the battery isnt working properly and that the device is switching off by itself? A replacement would do or money either way. Are there any other things i could say that could help me get a replacement?
This was a gift for my sister and its scratched already even with a case.

Could i not state that its not getting the advertised battery life? as its only getting about 10 hours of music, opposed to the 46 hours advertised. and also how would they check as they would have to keep it overnight to do that?
