I want to commission an artist to draw a painting from a headline in a local rag?

If you are going to pay for the painting or publicly display the painting, yes you do. The artist may be able to note that it is "in the style of" or "adapted from" the artist and the name of the piece and where it is located, or in this case published.

If no money is being exchanged and the painting does not look like a replica, then there shouldn't be any problems
