You actually do. I just bought that phone a month ago and ended up returning it. The first week that I had it, I couldn't even save my own background settings with an error data service screen getting in my way. It will literally continue to load for hours until the T-mobile elves shoot the data plan into your phone. I think it's pretty inconvenient too. There isn't a wifi capability, so the internet won't connect unless you buy the data plan ($30 a month in CA).
