I just got screwed by the police

It's in as of last August, the first month they got over a 1000 people, almost all regular people going with the flow of traffic on our biggest two highways. My buddy says it's been a constant topic on his Suzuki forum, and I know a guy personally who got hit with it. Middle of the night, on an almost deserted stretch of highway. He's fighting it but already over 4000 in lawyer fees but he did get his car returned, after all the impound fees. I've got a few select stretches of pavement that have about ten cars per day I open the bike up on, otherwise I'm almost never more than 15 km over. I wish I had a track closer than four hours away, I'm dying to find out how slow I really am.
 
Got my ticket on Saturday. 79 in a 55 @ 727 feet. This was not true. $242.00 was the amount.

LIDAR on this one. The "Senior County Deputy" in the white Mustang. Attitude, rude, abrasive and gave me some of his own personal thoughts on my riding style. He raised his voice to me twice and let me know, "do you know why I pulled you over cause if you say no, we are going to have a problem" WTH ?

I was moving with traffic, I saw him sitting there along ways ahead. He said I revved my engine as if to snub him. Who says that anyway? Ya, I'm 36, breaking in my 08 848 white Ducati with 325 miles on it. I stand out like a sore thumb, high profile, exotic. Like that makes any sense. As bike owners we already know these facts and accept them. Why make things worse right?

Funny thing is; the car I passed had followed us and pulled into the Chevron station and watched us. He then came over and let the officer know that he was a witness to the whole event and would testify that I was not speeding. How many times does a witness come over, take time out of their day, wait around for 25 minutes to give his statement during a traffic stop. Not often according to the officer.

This is going to court with counsel. I will not hold any personal grudges against the law (all cops here), but I intend to discount the LIDAR as evidence and prove I was wrongfully accused of a crime. From what I hear, it will be tough. The officer is recognized as an office of the court and his it's his word against mine.

Did he calibrate and test the LIDAR unit before his shift or the incident?

LIDAR have test buttons on them for the self diagnostics for the onboard electronics, but can not calibrate and verify speed and distance by itself with out a test object. Close enough does not count in court.

How did he do it? Pace car, ETC.

Does he have the documentation for these diagnostics? And if he used a pace car, when was the last time that bike or patrol car that helped him test had an official Speedo test and calibration by a certified engineer.

On that stretch of land, when was the last speed survey conducted.

What training on the LIDAR unit does he have.

If he has any photocopies of manuals, logs or other documentation..the charges can be dismissed.

Or does he even show up for the case.

I will push court dates out as long as I can S.O.L.

$242.00, thats a bargain.

I was hit by LIDAR 2 weeks ago, (in your numbers) 77mph in a 50 and it cost $604.00.

1mph more and I would have been charged, $1600.00 and court fees with a 3 month suspension.

I was doing the speed so I can't complain.

If you feel you were done wrong, fight like hell!

The problem with these dam things is that on a nice sunny day with a 4 lane highway and stuff all traffic, 80mph just feels like a walk in the park.

I find I can go no higher than 4th gear just to cruise at the speed limit.

How does your "points" system work in the US?

80 mph in Hawaii and your vehicle is getting impounded. They say 20 mph over the speed limit but the max speed anywhere on the island is 60 mph on the highway. The weird thing about this state is the police drive their personal vehicles with a little blue light attached to the top. Cop cars range from a Dodge Charger to a Toyota 4runner. The only cops to get marked cars are the Honolulu/Waikiki cops. The bike cops ride BMW. And on my last thread let me give a better example. How about if you walked in on your son raping a girl. Would you turn him in then? Or would you extend a "family courtesy?"
 
Again to all you boy's. Get a good traffic lawyer.

Pay the fine, take the supervsion (If you need to) and move on.

NEVER take a conviction....that is what a good lawyer will do for you.

I have beat the last two tickets I have received. The first one I beat using the "discovery" argument. After I received the ticket, I found a good lawyer who made a written request to the court for all records pertaining to my infraction. In the particular county I received the ticket, it is the WA St. Hwy Patrol's policy not to make copies of all information and send it out. So, when we went to court, he respectfully told the judge that based on my rights to "discovery", and the fact that the court did not supply me with the information to adequately defend myself in court, he would like the charges dismissed. Done. The judge dismissed the infraction and wrote "no discovery" on the paperwork. Cost: $335.00. Cheap for me based on the number of vehcles I have and what the insurance increase would amount to.
The second ticket was 77 in a 55 on radar (what is LIDAR anyway?) in a different county. I tried the same tactic, but this county fired me a one inch thick envelope of all the information, radar calibration, etc.. So, I found a buddy who knew a lawyer who knew the DA for that county. I called the lawyer and he said to send him $350.00 and he would "do what he could". Lo and behold, I received a phone call about 4 weeks later and he told me my infraction had been reduced to "license not in Possession" - a non-moving violation!! I had to laugh - especially when I thought about these two lawyers playing golf and eating steak on my dime! I didn't care, as my insurance didn't go up.
Moral of the story: Money talks and can get things done in our legal system. Get a good traffic lawyer and pay what it takes. BTW, on both charges I was guilty. Some might say that I did the crime, I should pay the time, and to some degree I agree. However, on a lonely stretch of hwy on a clear sunny day, 60mph seems a bit ridiculous. Just my opinion, not an attempt to start a public debate on morality as it applies to traffic violations! LOL.
