Got my ticket on Saturday. 79 in a 55 @ 727 feet. This was not true. $242.00 was the amount.
LIDAR on this one. The "Senior County Deputy" in the white Mustang. Attitude, rude, abrasive and gave me some of his own personal thoughts on my riding style. He raised his voice to me twice and let me know, "do you know why I pulled you over cause if you say no, we are going to have a problem" WTH ?
I was moving with traffic, I saw him sitting there along ways ahead. He said I revved my engine as if to snub him. Who says that anyway? Ya, I'm 36, breaking in my 08 848 white Ducati with 325 miles on it. I stand out like a sore thumb, high profile, exotic. Like that makes any sense. As bike owners we already know these facts and accept them. Why make things worse right?
Funny thing is; the car I passed had followed us and pulled into the Chevron station and watched us. He then came over and let the officer know that he was a witness to the whole event and would testify that I was not speeding. How many times does a witness come over, take time out of their day, wait around for 25 minutes to give his statement during a traffic stop. Not often according to the officer.
This is going to court with counsel. I will not hold any personal grudges against the law (all cops here), but I intend to discount the LIDAR as evidence and prove I was wrongfully accused of a crime. From what I hear, it will be tough. The officer is recognized as an office of the court and his it's his word against mine.
Did he calibrate and test the LIDAR unit before his shift or the incident?
LIDAR have test buttons on them for the self diagnostics for the onboard electronics, but can not calibrate and verify speed and distance by itself with out a test object. Close enough does not count in court.
How did he do it? Pace car, ETC.
Does he have the documentation for these diagnostics? And if he used a pace car, when was the last time that bike or patrol car that helped him test had an official Speedo test and calibration by a certified engineer.
On that stretch of land, when was the last speed survey conducted.
What training on the LIDAR unit does he have.
If he has any photocopies of manuals, logs or other documentation..the charges can be dismissed.
Or does he even show up for the case.
I will push court dates out as long as I can S.O.L.
