I have two kittens living in my garden?

I've tried the so called cats protection league and they want me to capture them so they can have them muted and then bring them back to me, the RSPCA aren't much better. The problem is I can't touch cats, don't know why just can't. The guy next door has already killed one kitten and the mother, I can't prove this but I know for sure.
