I have some questions about switching to a Samsung Intercept or Blackberry Curve?

I want to buy a Blackberry Curve or Samsung Intercept off Ebay, and switch from my cruddy Kyocera Wild Card. I'm on a Virgin mobile plan and I really enjoy the price, which is why I want a good phone to match. So....

1. Will the SIM card from the Wild Card be compatible with either of these smart phones?
2. When I switch the card to the new phone, will I have any problems?
3. Is using or buying an unlocked phone in any way illegal?
