i used abusive language to? a colleague, first of all i have to say that i am totally innocent of this,
the story goes like this, i had to take a delivery to a depot (i am a HGV driver) when i got there the security guard spoke to me in a derrogative manner, my excact response to him was, change your attitude mate and dont speak to me like i am a prat, at which point he has started to raise his voice and started shouting about this and that, i have told him not to raise his voice at me and to speak to me with respect, At wich point he has closed the sliding window on my arm, i have removed my arm he continues his rant and tells me to go away, which i do, i return to my cab and phone my office to tell them what has happened, the supervisor told me what to do and say, from my cab i relayed this info to the guard and he let me in. I have to say that at this point that neither of us has used any form of foul or abusive language.
two days later i had a phone call advising me that i had to attend a disciplinary meeting ,as this guy has made a complaint ,where i was suspended whilst they carry out further investigations.
I have several questions that i need help with,
what are my rights?
I am dissapointed that no investigation was carried out when i reported the incident.
I am seriously considering reporting the incident to the police for assault (with the window) but am worried that if i do this it might upset my employer even more.
i have in the past had a tweve months final written warning for a similar incident (that i was guilty of) that was two years ago, can they hold this against me?
any suggestions on a way foreward woukd be reqally helpful.
