I've heard rebuttal arguments that say "Separate restrooms are covered by the right to privacy."

So let me get this straight..........
You have a right to privacy from the opposite sex.........
but you don't have a right to privacy from the same sex?

Des: Your argument sucks.
It suggests to me that you think it's ok to discriminate on the basis of gender, but race.
Both gender & race are protected classes.
 
There is no right to privacy.

It is an implied right extrapolated from the 4th amendment:

Amendment IV

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
 
If either men or women were complaining that they should always share restrooms, this point might have some relevance. But they're not.

Are you suggesting, in any event, that racial segregation in schools is a GOOD thing?
