This past Saturday, I was at a bar and grill, when I fell down a step. The area was dimly lit, and the right side where a hand rail should have been, only had holes. There was nothing to grab on to, and I fell on hard on my knees. There was no sign that said "Watch your step" or any grips on the floor.
My left leg has a large round bruise under my knee, and my right leg has a 4 1/2 in L x 3 1/2 in W bruise around the shin area, close to the bone. At first I didn't feel much pain, but as the night went on, there was a burning and numbness in my leg.
I filed an incident report with the manager. He commented that I was wearing 3 inch heels, and that could have made me fall. I responded that I walked around the whole restaurant, up and down two flights of stairs, and didn't fall once. I took pictures of the area in natural lighting and the missing rail. I have also taken pictures of my injuries. I received a copy of the incident report.
I am going to the doctor tomorrow (Monday) to make sure I didn't severly damage anything. The middle of my back hurts now, and I am experiecing on and off pain where it is hard for me to walk. I am probably just sore, and I don't want to be one of these crazies that sue because I fell, but I am really in a lot of pain. What steps, if any, do I need to take? I am fairly young, 26, healthy, so I'm unexperienced in these areas.
I also have two witnesses who saw the fall occurr, and they are both listed on the report.
Just to clarify:
-I was not drunk
-The witnesses admitted they also tripped were able to hold on to each other to keep from falling
-There are holes in the wall where the railing use to be, and the manager admitted he did not know the railing was missing
When I said I walked around the whole restaraunt, that excluded the dimly lit place where I fell. I didn't see that area until I walking towards the steps. It was two wooden steps, and the bottom blended in with the floor, causing me to trip. I thought I was stepping on the floor, not the second step.
