I crashed my friends car, can she sue me?

So my gf let me drive her car one night, and I crashed it. It was my fault. I also had a little to drink that night too, but she let me drive anyway. We agreed I'd pay $70 of her insurance. Now she claims it's $500, sum $240 more. We broke up, so she wants to sue me now. Can she really? She let me drive her car.

Even when she might share some of the fault, "Yes" she can sue you. But probably the Court will reduce her claim to a much more lower number. Probably you could get a 50% deal.

By the way if the insureace is already covering her damage in full then she can't sue you for the same amount of money. She can't get paid twice for the same damage; in that case you can only be required to pay any amoubnt uncovered by the insurance.

EDIT

By the way if you got hurt during the crash you could try to sue her for allowing a drunk person to operate a car.

It doesn't sound to me like anything is in writing or any police were called in or anything to prove who did what here. Verbal agreements are hard to prove. The courts don't like verbal only agreements. For all they know she is just a woman scorned. If there is no proof or witnesses then she is pretty much up a creek without a paddle.

She let you drive - did she ask you to crash the car? It's your responsibility if you were dumb enough to drink and drive. pay up and stop whining
