okay so my lanlord is taking me to court for not paying rent. I stopped paying due to the neglect of mold growing through out the apartment after telling the landlord verbal and in writting about it. He sent the maintanence man out and said it wasnt anything to be concerned about. I have a 2 year old child and I cant keep cleaning it with bleach every other day thats not healthy. What i need to know is when the maintanence guy came out he seen the problem with the flooring behind the toilet roting away and did nothing about it. There have been other tenants that have also complained and recieved no response. So is it worth going to court? I have pictures and statements from the other two tenants. Im a little nervous and could use the advise because we don't have a lawyer to go to court with us. Thanks
you must have the rent money sitting in an interest bearing account when you go to court to prove the only reason your not paying is lack of repairs. you need to start collecting receipts for your clean up supplies and keep a long of all times it takes you to clean it from today forward back a lil if you can.. als if you or your child or anyoen else in the house is experiencing sickness colds stuffy noses ect ecet since you noticed this mold write it ina note book then call your dr and ask any time anyone in your home has gone to the dr since the black mold was noticed also collect reciepts ro write down the cost of meds the cost of dr visits.. read up on black mold on line and print out articles about symptoms you or your child have experienced. go prepared you dont need a lawyer but you need to know what you will say make your points valid. and bring your proof that you asked in writing for this to be fixed try to provied dated of when someone came out and write in the book exactly what was told to you to the best of your knowlege have it writtten down before court easy way take a note book put fold the paper in half on each page write on the left side exactly the subject of each point on the right write the days times facts ect ect.. this way when you go to court you have it all organized and easy to find.. also highlighters of different colors for different topics on the let side margin is a great like very left write illnesses the next write dotcors and then meds and what the doctor may of said to you or what you beleave was the cause of any sickness.
in 99% of cases alot of rent money will be taken off and given back to you. but you must have that money when you go to court. you cant say well i just spent it on this or that. any money that was removed for clean upa dn repairs must be documented with receipts... i submitted some links not sure what state your in but most are pretty similar in laws also i submitted links to sites on illness.. good luck
Yeah the worse the court would make you do is pay the rent! But as the landlord it's his job to give you safe housing & and black mold is far from safe
