i bought an i phone 3gs on e bay but it has a password how do i get it off?

i bought i phone 3gs on ebay and it arrived but it still has damn password on it. is there anyway of opening it. or have i bought a dud i phone i tried e mailing the guy but he has not got back in contact thanks for answers in advanced
