i bought a used phone..?

hey i bought a used phone off of craigslist and it doesnt work i mean it turns on but when you put the sim card in it doesnt call, i tryed calling the guy i bought it from but he didnt pick up and i cant reach him, is there anything i can do? i think he might have stole the phone and att deactivated it is there a way to activate it?
