It all started a couple months ago.... I was in Chicago for training for work, during class I got a terrible pain, it was toward the end of class so I waited it out until I got to my hotel room when I knew something was seriously wrong, my friend in the room next to me heard me screaming in pain and was helping me pack up. I told my instructor something is wrong and I'm going to hospital and I wanted to be home with my family for this. I got the last flight home and went into the ER, I was having pains throughout my body and could barely walk.
Around 6am I was let out and given Medicine, I somehow got epydidmytis (no sexual activity in a year) in both testicles.
3 ER visits, 3 different doctors, and surgery within 2 months
I told my boss and was keeping him up to date with what was going on, my last visit with him I got fmla paper work and talked to someone in the company via phone about what was going on. I told them my doctor said 2 weeks til surgery and 4 weeks until I can work again. I was told to return paper work when I could after my doctors sign them.
Somehow my boss told me for all of this I got marked down for attendance but I don't have to worry because it was just 1, I didn't think this would cause a problem because in a couple weeks a couple tardies where getting taken off record since it was over 6 months ago.
With still having the same problem, I just got surgery because of the abnormally large swelling and pain in my left testicle.
A few days before my surgery I was called by my boss saying I have been moved to a letter C in attendance and I am now terminated. When I went to Chicago I was a letter A.
I'm apart of a union and I talked the top guy and he said he went over it and the company made a mistake.
I got fired for them making up attendants issues while I was on sick leave before I could turn in fmla paper work. This goes against the union policy and the attendance program they have set up.
Am I able to create a lawsuit over this?
