Husband Getting a new public defender. Also how long can you be hold in jail...

...before your case can be dismiss? I can not get into details but my husband been lock up for 11 months. His public defender acts like he don't want the case. He has been sent to court about 3 times the case went to grand jury also a case review. The last time he went to court his public defender ask the judge can they speed it up cause my husband been lock up to long. They gave a date then cancel the date cause they say they still don't have any thing on my husband. Can anyone help us with this situation next month will make a year my husband has been lock up. We live in New Jersy.
 
Legally, I believe it's either 60 or 90 days. The Sixth amendment to the constitution grants you the right to a speedy trial. Your husband might have the right to ask to be released and all charges dropped immediately, with prejudice. Ask your lawyer about this!
 
there are people in jail that have been fighting case's for 3 and 4 years....I know that doesn't help, but its true
 
Your husband should of been offered bail at some point unless the prosecution established that he was a flight risk. As for how long they can hold him this is hard to tell without further information but for any capital crime he must be indicted by a grand jury if a grand jury returns a no bill then he should of been released but again this is hard to tell without further information
