Im 17 year old and i was in an accident the other day. I was waiting at the stop sign so that I could go across an intersection. I waited for a while for the cars on the other side to go by and Iook on my side to see if anything else was coming. When I did not see any headlights apporaching and the cars that was parked blocked my view I proceeded into the intersection. A woman hit me in the middle of the intersection on my driver door and claimed that I ran the stop sign. I never run a stop sign and never got a ticket and no tickets was issued at the scene. The woman driving was pregnant and it was her second accident that week. I'm not entirely sure if the accident was in my fault or hers but I did not get in the ambulance nor did I stay in the car I checked to see if the people were alright and called my mom. Now the question is if the lawyers hear both of our cases would I be in the wrong for not being able to see her or would she be in the wrong for not having controll of her car? Also because she didn't hit my light or my tire but directly in my door does that mean I will not be able to get my car fixed? Also I have liable insurance and the woman had full coverage so someone please tell me if this will work out or prepare for the WORST?!?! Oh an should I sue her cuz my mom says I should?? plz help me
you did the right thing but also you didnt really do the right thing at the same time. driving at night is one of the most dangerous things you can do in a car. and you should have just inched forward until you could see around the parked car.... technically she was in the right of way because you were at the stop sign and she was on the busy road. BUT she cant prove that you did or didnt stop at the stop sign so she really doesnt have a case. having control over her car has nothing to do with the accident. you pulled in front of her therefore causing an accident. things happen you can try to sue her BUT its a matter if proving your case and trying to get the judge to go in favor of you. it has nothing to do with a lawyer ruling (its the judge who decides) because like i said SHE had the right of way and you pulled in front of her....you can try but you may not win.
