How to argue in favor of this case?

I have been assigned a court case for my government class. My case is that the President began to send supplies and troops to the middle east because the dictators of Iran and Iraq had begun an invasion of Kuwaiti. Back at home in the U.S. workers had a nationwide strike against all the tire companies. Fearing that the U.S military(who depends on a huge tire supply) would suffer from the strike, the President issued a proclamation directing the federal government to take possession of all the tire companies.On behalf of all the tire companies The Allied Tire company protested against the President's actions, so they sued the DOC. I have to argue on behalf the allied tire company and against the DOC. What are some good strong arguments that i could give? Any suggestions would help a lot!

Not for sure, but:

Immediate possession of major companies might possibly against government regulations; especially if the President did not first consult the Senate or House of Representatives.
