How the military can screw you

They want to give you an Administrative Discharge, but if you fight it, they cannot, legally (Military Law) do that without express consent from a very high ranking officer (i.e. Rear Admiral + [ or Air Force equal]).
 
If they're chaptering you, it's obviously not for drugs. Unless you admitted to having used them or smithing. Like James said, they need a field grade officer to sign off on this, but it could be for anything. Then can't chapter or discharge you without proper evidence and/or a court marshal

You should still get some kind of board hearing for chapters though; go see your JAG officers. Don't let them screw you man.

Are you sure this is only for drugs and not conduct or something else?

Yea its not just me they are doing this for its quite a few people and are LT has signed off on it. I just don't understand how they can do this without evidence i just wanted to get it off my chest. Sorry

Go talk to JAG, see what they say. Nobody is trying to argue with you, we're trying to help you. :) Everyone in this thread is either a veteran or currently enlisted. (not sure if Nailbomb is though)

They can't. Your lieutenant can't sign off on that. Unless there is some type of government/air force conspiracy at work here, then chances are it is for something else. Have you ever been in trouble for anything while in the force?
 
I have no clue what the rank structure for Air Force or Navy is, but I know how it goes in the Army.


  1. Squad/section officer signs off on Article 15 (O1/02)
  2. Ar15 goes before company commander. (O3)
  3. Ar15 goes before battalion commander and SGT Major (O4 and E9) - If it's only UCMJ action (restriction and extra duty) it stops here.
  4. For any kind of seperation action it continues on to Brigade (O6)

Which leads me to believe that if they are trying to start seperation actions, it's in the very early stages. And like we've said multiple times in this thread, you need to go talk to JAG.
 
Most of the people writting a response to this post don't know the situation or whats going on. The military can and will take whatever they want from you. Theyre the fucking military. You signed your life away. And yes they would take hair samples for drugs to the moron who said they wouldnt. of course piss tests are cheaper but if you want to know if theyve done anything in the past few months obviously pee would not tell that, erego hair tests. why else would they take it? and to whoever is quoting straight shit from the UCMJ...my god get a life. she was just ranting about stuff thats going on and your trying to act like you know all about this shit. just shut up if youre going to try and sit high and mighty. it can happen and it is. if any of you replying are in the military, i really hope youre not this stupid in the field. :mfinger:
