How the military can screw you

So in the civilian world if someone were to accuss you of doing drugs they would need evidence. They couldn't send you to jail just because someone said they saw you do it. But here in the lovely military life if someone says you did it they don't care if the person who said it is in jail or just got busted for something they believe that person and you are either on your way to jail or out on you ass. Thanks uncle sam!!!! So now half of are squadron are out on their ass because someone pointed the finger at them. It doesn't matter if their a hard worker or innocent they don't care because the AIr Force is over manned and they can afford to get rid of us. Nevermind that some of them have no where to go and thats why they joined. I just had to get that off my chest...
 
That is not true i had 8 UA's and they cut my hair they all came back negative and thats the same with at least 10 other people and we all are getting out cause of it even though they have no proof
 
Yes it is. They might try to fuck with you, but that would never stand up in a court marshal. Go to JAG and explain what's happening. You CANNOT receive UCMJ for drugs without a positive UA.
 
Unless you admit to it. Self admission is the same as guilt weather or not you did what you are admitting to... Other than that they need to conduct a drug test or actually catch you in the act or possession of a illegal substance to make something like that stick by the UCMJ. Fight it. Go to legal, dig your heals in and fight. I would.

Your Article 32 rights under the UCMJ provide you with specfic rights of the accused. You are accorded the right to a trial by court-martial and to a military attorney.
You cannot be prosecuted under the UCMJ unless there is evidence against you. If there is evidence against you and you are tried by court-martial then the military must convince the JAG or panel that the evidence is solid enough for a conviction. If it is not, then the accused is acquitted.
If you are accused of something you have the right to DEMAND a trial by court-martial, that cannot be refused.
I would imagine that there are other factors involved, and I would also submit that your peers are being administratively discharged for other reasons.
 
jung is right... I know a guy who was caught with weed in his lap in a cab while intoxicated and they had to throw it out because the captain of the ship tried him for usage before the test came back... he was givin seperation but before it was imposed the test came back negative... he got a JAG and got it overturned..

course he fucked himself later by making mash wine in a locker and getting caught...
 
Are you saying that they analyzed your hair? If that's true then you have other issues that are contributing...no one asks for a hair sample if they aren't after something.
 
yea they took a hair sample to see if i had been doing it. But of course it came back negative. I asked to go to a court martial but they said that it was a wasted of time and money so they just want to give me an admin discharge. We trying to fight it but it is happening to more than just me.
 
It has already been stated by several other ranters here, but here goes.

When court marshalled, you stand before a panel of high ranking officers. These officers don't need any knowledge of law, because they are to obey military law. But in military law, just as in civil law, you are entitled to due process. They can't just throw you in the brig, or discharge you for no apparent reason. If you didn't do any drugs and do your job as well as you can, then you are in good shape, there is nothing within military law that dictates absolute power like that.
 
How are you going to tell me it has nothing to do with drugs when i am going through it right now. This is what is happening now we all got LOR's instead of Court Martials and we all are getting admin Discharged. If you would like I can quote my LOR for you guys.
 
They're telling you that because quite a few people on this site have either been in, are in, or are going into some branch of the military. Taking hair samples is nearly pointless when a piss test is easier, shorter, and more accurate. I don't think it's got anything to do with drugs either.
