How many yrs can one be in the Army as an E4?

He's been in for 9yrs. Recieved an article 15 in 2005 , busted down in rank from E4, earned it back in 2007. Re-enlisted in 2007 during second deployment, and changed MOS, returned to AIT w/ prior service. When he received his orders to return to prior duty station the postion he filled was to the one who was promotable.He's Currently deployed w/ new unit who want to send him to the board.
I truly believe he does want to be promoted.He has always had an excuse for everything from pionts, not enough time for correspondence classes, to PT tests.
He once told me he can retire out as an E4 in 15 yrs. BUT, then, now tells me( new law?)he can only stay in as an E4 for 10 yrs thats why his unit is pushing him to go in front of the board. His MOS is an Aircraft Powertrain Mechanic. He is due to ETS in 2011.
So if he does not get promoted , can he receive an Honorable discharge before his ETS ?
 
the High Year Tenure numbers have indeed been lowered.

he will be kicked out if he does not make E5( and there really is no excuse not to)

as for the characterization.. could be Honorable, could be GUH. which he does NOT want and it will derail his GI bill and some VA bennies.
 
i believe its 10 yrs, but i was reading an article in the army times... i thionk if they are e4(P) u can be in a bit longer...
 
The regulation that you need to look into is AR 601-280 The Army Retention Program dated July 2008. What is gonna happen is he is gonna reach the RCP (Retention Control Point) for his rank which, if I understood your question right, is 10 years for a non-promotable E-4. The catch is since he has an ETS date of 2011 he will be allowed to finish out his enlistment and recieve an honorable discharge. Once he reaches his 10 year mark the commander will but a BAR of re-enlistment on him and he will not be able to re-enlist until he becomes promotable which at that time the BAR will be lifted and he can continue to serve his country. Now lets say he gets his promotable status and re-enlist, the max he will be allowed to re-enlist is for 5 years which at that time if for some wild reason he doesn't pick up E-5 he will be in the same predicament he is in now. From what you say he is lazy. It is too easy in today's Army to get promoted especially since they are handing E-5 out automatically.
 
Yes the times are changing in the army , I will have to say points are a BIG part if he does get his promotable status great he will be good for 15 yrs but he has to make points to get promoted and the MOS you said he is in is 15D Power Train right now there points are maxxed out at 798 very hard to make that amount of points in that job depending on what type of unit he is in wether it be a AVIM or AVUM unit time could be a big issye especially if he is deployed , so i wouldnt call him lazy as the post before mine did E-5 isnt always just handed out like some tend to beleive especially when a MOS 's points stay maxed out for yrs.
