how many truancies can a 5 yr. old get before getting in trouble?

im from the state of wisconsin and my 5 yr old is located with me outside his school district due to the incarceration of his father and the deportation of him also, i called the school and notified them of the situation, they said he will be marked truant untill i get transcripts transferred...but i did call and notify them of this
