How many months in rent arrears do you have to be before being serviced notice to

quit? UK Only please? We had a hand delivered letter serving us a Section 21 (1) (a) and when we called our letting agents they said (very smugly) 'You havent paid any rent!' When i asked what they were on about they told us that the extra payment for June rent had not been recieved into the offic (We'd agreed that Id pay the rent for June at the end of July but id set up the standing order for 30.08.2010 instead of 30.07.2010) I let the letting agents know that in a weeks time i would personally call into the office and pay June and this months rent (The rent money for June has by this point been eaten up in other bills) They said this is fine but the eviction still stands, I understand that i agreed to pay on a set date and had made a mistake with this but after 2 years of living in the property and ALWAYS paying rent in full and on time i cant understand why they have gone straight for eviction! I have been in constant contact with the letting agents so its not as if they can say that they have never been able to contact us and we always miss rent, they have even been to inspect the property on numerous occasions (at our request due to it falling apart on the inside) and we have been told that we have done wonders for the place!

Can they actually serve this notice to quit when only owing 1 months rent? (we only pay £375 pcm) They never renewed our tennancy in June either............

Moreso stressing as we were planning to move in the next few months anyway and worried that if they are going to try and use the 'rent arrears' as an excuse this could effect a new tennancy
