If you cannot work, don't take "no" for an answer from your own insurance company. File a complaint with the Insurance Department of the state where you live.

You should not settle your claim until you are completely healed and know what are your injuries and expenses.

I was rearended by a truck. It took me six years to get my claim settled, and I knew the ropes.
 
...almost a year!!!? I was hit from the back at a red light. My ins co was paying me wage losses they sent me to a neurologist and he said I could return to work so they cut me off. All other docs said I cant return to work I haven't been diagnosed yet. I need this to settle becuz its hard to live with no income and two kids.
 
What have you done to settle it? They do not settle themselves. The other driver or his insurer is not going to just cut you a check. Instead, you must present a viable threat to sue and to win. Such cases can settle in a month or in years.
