how long can it take for a jag officer to pick up a deserter from sac county jail?

My husband was pulled over for a minor traffic ticket..and it turned out that there was a mil warrant out for his arrest. he has been in jail for 3 days and is waiting for the mil to pick him up. He never passed basic training because he was in the hospital the majority of the time. The last time he was in the hospital there back in end of may he was taken by to MP officers from the hospital to the gate. Was told that he could go and he is no longer in the army. They didn't give him any paperwork took his mil id and tags and he had to find his own way home..and now this crap. I've heard that 95% of these cases are dishonorable discharge..but I just want to know the process of how long it takes for him to be picked up at the jail and to have him stand before a judge and be discharged and go home. He literally thought it was ok for him to leave..but because he didn't do his part of following up they consider him desertion.. I'm not looking to fight this crap..just to know how long it may be before he is able to come home.
 
Your husband LIED. It takes at least a week to get kicked out of basic training and there is ALWAYS paperwork. The story you gave would get the MP a dishonorable discharge.
