How do I take someone to a small claims court or go about taking up legal action against Vodafone?

Long story short after 2 years of hell due to an in-law using my name on a phone contact I stupidly decided to upgrade my contract with Vodafone.
This was ONLY done as when I called to do so I made it very clear to Vodafone that my in-law was NOT allowed to upgraded his phone in my name again. So a few months pass and my phone is cut off for 'miss-payment'. I called up Vodafone as I don't have a direct debit so pay my bills over the phone, and to my horror they tell me it is the other number on the account (which was upgraded on-line - not sure how as I have not been able to access my account for well over a year due to restricted access).
Vodafone have since buggered me about for the the last 3 months reporting it to there fraud team and have now suspended my account with a ?500 bill forcing me to buy a pay as you go phone. The other party in this cannot pay the bill and refuses to as I had his phone cut off when I found out he had it as the 2 years previous he never paid bills on time and build up debt after debt.
Vodafone have AGAIN launched another fraud cause and are point blank refusing to put my phone back on despite this being partially there fault. They have refused me transcripts of my calls unless I have a police reference number (despite being told by the police this is not a criminal offence as I have not suffered a finical loss and it is just my credit that has been effected.). They have also told me that because the account was upgraded on-line that it will likely bounce back again as he would need the details to go on-line.
The two people I spoke to at Citizens Advice where less than helpful and told me to write to my in-law to pay and if not take him to a small claims court.
Which brings me to hear, I fully agree that my in-law is at fault but so are Vodafone for allowing the upgrade as almost all the advisor's I have spoken to have said that it is clearly stated on the notes on the account that I am the only person who can upgrade and that the other number is NOT to be upgraded. I am a 21 year old completely stressing out. Any advice would be much appreciated.
